Terms of Service for The DSQ

Welcome to The DSQ! These Terms of Service ("Terms") govern your use of our website, thedsq.com (the "Site"), and your purchase of products and services from The DSQ, whether online or in our physical retail store ("In-Store").

By accessing our Site, using our services, or purchasing our products, you agree to be bound by these Terms and our Privacy Policy. Please read them carefully.

1. Agreement to Terms

By using our Services (defined below), you agree to these Terms. If you do not agree to these Terms, you may not use our Services. We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this Site. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

2. Products and Services ("Services")

The DSQ offers fine jewelry, including rings, necklaces, bracelets, earrings, and watches, as well as related services such as custom design, repairs, and appraisals.

  • Product Descriptions: We strive to be as accurate as possible in our product descriptions, pricing, and photography. However, please note that gemstones and precious metals may have natural variations in color, clarity, and character. Dimensions and weights are approximate. We do not warrant that product descriptions or other content are entirely accurate, complete, or error-free.

  • Pricing: All prices are listed in US Dollars ($USD). Prices are subject to change without notice. While we work to ensure accuracy, pricing errors may occur. We reserve the right to cancel any order containing a pricing error, with a full refund provided to you. Prices displayed on the Site do not include taxes or shipping charges.

  • Availability: All products are subject to availability, and we cannot guarantee that an item will be in stock. We reserve the right to discontinue any product at any time.

3. Online and In-Store Orders

  • Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our final acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason.

  • Payment: We accept the following forms of payment: All major credit cards, we also have financing option available from Acima, Wells Fargo, Progressive etc. By submitting an order, you represent and warrant that you are authorized to use the designated payment method.

  • Title and Risk of Loss: For online orders, the title and risk of loss for all products pass to you upon our delivery of the items to the shipping carrier. We are not responsible for lost or stolen packages after they have been delivered. All shipments are insured for their full value during transit.

4. Custom Design, Special Orders, and Repairs

  • Custom Design: All custom design projects require a non-refundable deposit before work can begin. You will be part of the design process and must provide final approval on the design before fabrication. Full payment is required before the final piece is delivered.

  • Special Orders: Special orders for items not typically in our inventory may require a deposit and are considered final sale.

  • Repairs: We are not responsible for the condition of jewelry or gemstones upon receipt for repair. We will document any pre-existing damage. While we exercise the utmost care in handling your items, there is an inherent risk in working on jewelry, especially items with delicate settings or fragile stones. Our liability for any damage or loss of an item left for repair is limited to the cost of the repair or replacement of the item, at our discretion.

5. Shipping Policy (Online Orders)

  • Processing Time: Orders are usually processed within 1-3 business days]. Custom orders require a longer processing time, which will be communicated to you.

  • Shipping: All orders are shipped fully insured via a secure carrier (e.g., FedEx, UPS). An adult signature is required upon delivery for all orders over 500 dollars

  • International Shipping: The recipient is responsible for all import duties, customs fees, and local taxes.

6. Return, Exchange, and Warranty Policy

  • Return Period: We accept returns of unworn, undamaged merchandise for a full refund or exchange within 14 days of the delivery date (for online orders) or purchase date (for In-Store). The buyer has to pay the return shipping.

  • Condition: Items must be returned in their original condition, with all original packaging, and must be accompanied by all documentation, including any diamond grading reports or appraisals. Items showing signs of wear or those that have been altered, resized, or damaged will not be accepted for return.

  • Non-Returnable Items: The following items are considered final sale and are not eligible for return or exchange:

    • Custom-designed or engraved items.

    • Special orders.

    • Items that have been resized or modified.

    • Sale or clearance items.

  • In-Store vs. Online Returns: Online purchases may be returned via mail or at our physical store. In-Store purchases may only be returned or exchanged In-Store.

  • Limited Warranty: The DSQ warrants that our products will be free from manufacturing defects for a period of a year from the date of purchase. This warranty does not cover damage resulting from normal wear and tear, accidents, misuse, or loss. This warranty is void if the item is repaired or altered by any jeweler other than The DSQ.

7. User Accounts (Online)

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

8. Intellectual Property

All content included on the Site and in our store, such as text, graphics, logos, images, and jewelry designs, is the property of The DSQ or its content suppliers and is protected by United States and international copyright and trademark laws. You may not use, reproduce, or distribute any content without our express written permission.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DSQ, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Bernalillo, New Mexico.
